I don't think he should have too. If an add apears to be a scam, people told them it's a scam, Ebay should have a procedure for verifying it. Instead they don't try. When they get enough complaints they yank it.

On the flip side if they think you are selling too many pieces of "X" and they think you should be a dealer, or doing something that they don't like, they will yank your add and even your rights before you can say "What the hey?"
