Well first off, the drunk would need to be convicted. Second whether or not the insurance pays for it is a matter of contract law with terms and limitations. I'd have to read the fine print.

Definitely if the car is stolen, even by a drunk, the car is insured PERIOD, to whatever the terms of the contract are. There are dollar limits on the policy, set by the purchaser and there is a new clause included on all policies in NY that is called "under insured motorist".

Motorcycles can't get personal injury coverage as far as I understand it but to be honest with you, I never asked my insurance agent if I am covered if I am drunk? If I get a chance, I'll ask.

I would tend to think that you are covered under any conditions since people with one DWI conviction pay something like a minimum of $10,000, and the limits of coverage are reduced because they become an assigned risk. Two DWI's presuming you still have some kind of a license, you would be uninsurable.
